Rep. Don Beyer, a U.S. Congressman representing Virginia’s 8th district since 2015, posted a series of tweets on January 15, 2026, addressing the interpretation of a statute related to tips and illegal activities.
In his first tweet, Beyer stated, “The thing is, AS WRITTEN ‘The statute makes no mention of distinguishing legal from illegal activity… Congress made no indication that payments for illegal activities should be excluded from the tips rule.’ It’s important to clarify this point so anyone affected will know” (January 15, 2026).
He continued by presenting a hypothetical scenario in a follow-up post: “Our comment asks IRS to consider a particular imaginary case: ‘A political operative is a clear front runner for a high-level political job within the next six months. He is given $50,000 in cash in a bag in a parking lot, after a lunch discussing hopes that the payor will” (January 15, 2026).
In his final tweet of the thread, Beyer explained the purpose behind raising such examples: “Our letter concludes, ‘In crafting this example, and in the interest of additional clarity, the final regulations should further explain whether and when a payment like this is illegal.’ We thank @USTreasury and @IRSnews for their attention to this matter.” (January 15, 2026).
Beyer’s remarks were directed at fellow members of Congress and tagged agencies including the U.S. Treasury Department and IRS. The discussion centers on clarifying how current statutes address or fail to address payments tied to potentially illegal activities under tip reporting rules.
