U.S. Immigration and Customs Enforcement lodged an immigration detainer against Luzvin Garcia Moran, a Guatemalan national, following his April 12 arrest in Arlington County, Virginia, for attempted sexual assault.
According to an ICE press release, 28-year-old Garcia Moran was accused of approaching the victim, making sexually explicit comments, and physically assaulting her. He faces charges including abduction with intent to defile and sodomy by force, according to the release.
ICE says Virginia operates as a ‘sanctuary state’ under Gov. Abigail Spanberger, with policies that limit local cooperation with federal immigration enforcement, including honoring ICE detainers. The agency says Arlington County has followed these guidelines, allowing some individuals to be released from local custody despite federal requests.
Nationwide, nearly 70% of noncitizens arrested by ICE have criminal convictions or pending criminal charges in the United States, according to DHS. In early 2026, the agency arrested hundreds of individuals with child sex offense convictions across multiple field offices.
ICE carries out federal immigration laws through its Enforcement and Removal Operations division, which conducts operations to locate and arrest noncitizens with criminal records. ICE maintains a focus on prioritizing the removal of individuals with serious criminal histories, according to the agency.
